FORS Secures Confidential Settlement for Diner Cryogenically Burned by Liquid Nitrogen Dessert
FORS attorneys represented a Miami-Dade woman who suffered cryogenic burns when liquid nitrogen used in a tableside dessert presentation spilled onto her while she was dining at a Miami restaurant. FORS sued the restaurant's operator and three related companies in the Circuit Court of the Eleventh Judicial Circuit on theories including negligence, premises liability, negligent failure to warn, and strict liability for an abnormally dangerous activity.
Mediation ended without an agreement. The defendants then moved to dismiss the complaint, and the court denied the motion. FORS then pressed aggressive discovery against all four defendants, serving written discovery and setting the depositions of their corporate representatives, and the case resolved in a confidential settlement.
