As reported by the South Florida Business Journal, FORS recently obtained a significant victory in a commercial lease dispute involving a shuttered restaurant in Miami’s Brickell Financial District. The tenant, who had operated a high-end dining and entertainment venue, was ordered to pay over $1.33 million in unpaid rent and related damages after failing to meet its lease obligations.

The case centered around a two-level restaurant space in a prominent mixed-use building, featuring more than 8,600 square feet of interior space and additional patio seating. The lease, signed in 2021, committed the tenant to substantial annual rent obligations, which went unpaid beginning in early 2023. After repeated efforts to resolve the matter without litigation, FORS initiated legal proceedings.

Following swift litigation, the court awarded a judgment that included back rent, holdover rent, accelerated rent, and pre-judgment interest. FORS lawyer, Daniel C. Fors, who led the case on behalf of FORS' client, commented: “We already secured possession for our client in the court case, and the prime Brickell property is currently being offered for rent again.”

At FORS, we often represent commercial landlords in ensuring lease enforcement and timely legal action when commercial tenants default. We are proud to have delivered a just result for our client and to help restore the value of this prime Brickell property.
