Business counsel for professional athletes

Your career is on the field. Your business is everywhere else.

FORS represents professional athletes in the companies, contracts, investments, and real estate that grow around a career, and in the disputes that sometimes follow.

The business beyond the game

A professional athlete is also a founder, an investor, a property owner, a brand, and a partner in other people's ventures. Often all at once, and usually before anyone has built the structure to hold it.

Money arrives before structure does. By a third or fourth season a player may own property in two states, hold an interest in a business he has never seen a balance sheet for, and have signed several agreements nobody read closely. This happens when opportunity moves faster than the paperwork.

The difficulty rarely shows up on signing day. It shows up later, when a deal renews, a partner stops answering, or a property has to be sold and no one agrees on who owns what. Our job is to make sure the paperwork catches up with the opportunity, and to be in your corner when it does not. Ultimately, the job is to protect you, your family, and what you are building, which must continue to provide for years after you are done playing.

A playing career is short. The business it creates is not.How we counsel athletes, from our article on representing NFL players off the field

How we help athletes

Legal counsel for the business of being an athlete

We counsel an athlete the way we counsel the founder of a growing company. The matters fall into three groups: what you build, what you own, and what you have to protect.

Build

Setting up companies, deals, and agreements so they hold up under weight.

Business formation and governance

Entity selection, operating and shareholder agreements, and the rules for how partners make decisions, get paid, and leave.

Transactions, acquisitions, and joint ventures

Buying into a business, selling one, or building a venture with partners, with terms that reflect what you are actually putting in.

Commercial contracts

Review and negotiation of the agreements that run a business: vendors, leases, licensing, services, and the ones you are asked to sign on the spot.

Endorsement and sponsorship agreements

Exclusivity, usage rights, morals clauses, payment terms, and renewals, read with an eye toward the next deal as well as this one.

Own

The assets a career produces, and the diligence before you add to them.

Real estate acquisitions and investments

Residential, investment, and commercial property in Florida and beyond, from contract through closing and ownership structure.

Legal due diligence on opportunities

Before the wire goes out: who the counterparties are, what the documents actually say, and where the exposure sits.

Asset protection and risk management

Holding structures, insurance coordination, and the agreements that keep one problem from reaching everything else.

Protect

When relationships change, and for the people who come after you.

Business litigation and dispute resolution

Partnership breakups, breach of contract, fraud, fiduciary claims, and real estate disputes, handled by lawyers who try cases.

Estate, succession, and legacy planning

Wills, trusts, and succession plans for businesses and property, designed for a family whose wealth arrived early.

Ongoing outside business counsel

A standing relationship for the questions that come up between deals, so you are not finding a lawyer every time one does.

Discuss a matter Most matters touch more than one group. Start with the question, and we will sort out the category.
Working alongside your team

An extension of the people already around you

Most athletes already have an agent, a financial advisor, an accountant, and often a business manager. Good advice is coordinated advice, and we are built to work inside that group rather than around it.

We take the call from the advisor who spotted an issue, turn documents around on the timeline the deal actually has, and report back in plain language so everyone is working from the same facts. Many of our athlete relationships begin with a referral from a professional who needed legal counsel they could trust with a client.

A clear line

We are not sports agents and we do not negotiate playing contracts. We handle the legal and business matters that surround a career, and we work with the agent who handles the career itself.

Relationships beyond the office

We come to the athlete

The NFL runs on relationships and on an in-season calendar that does not bend. Our athlete work is built the same way.

This past August, that meant spending a joint-practice day at training camp with players we represent and the people around them. The visit was not a marketing event. It was the normal rhythm of a practice that already represents NFL athletes: showing up where the client is, understanding the demands on his time, and handling the business so he can concentrate on the season.

We are also, for the record, a firm full of Dolphins fans with season tickets. That is the secondary reason we are on the field. The first reason is our clients.

Why it matters who drafts it

Business counsel, not just transactional lawyers

We draft with the dispute in mind, and we litigate with the deal in mind.

FORS has spent more than four decades in both halves of business law: structuring relationships, and resolving them in court when they come apart. That combination changes how we read a document.

A lawyer who only closes deals sees the agreement as it is signed. A lawyer who has also tried the breach-of-contract case sees the clause that will be argued over three years from now, the partner provision that quietly decides who controls the company, and the exit term nobody negotiated because everyone was friends. We bring both views to every matter, which usually means a cleaner agreement up front and far less to argue about later.

What the agreement coversWhat we are also thinking about
A new company with partnersWho decides when the partners disagree
An endorsement dealExclusivity that blocks the next deal
An investment opportunityThe financials nobody showed you
A property purchaseTitle, ownership structure, and the sale
A handshake with a friendHow it ends if the friendship does

None of this is adversarial. It is foresight, and it is the difference between a document that looks right and one that holds.

The firm behind the representation

A business and litigation firm first

FORS has represented clients in sophisticated business, real estate, and litigation matters from Coral Gables since 1982. Our athlete practice sits on that foundation.

The firm handles business and commercial litigation, real estate litigation, corporate and transactional work, and estate planning, in English and Spanish, with a trial practice that has taken cases through verdict. The attorneys who lead our athlete work are the same ones who lead the firm.
